End-User License Agreement

Please read this End-User License Agreement ("Agreement") carefully before downloading or using NZBolt ("the App").

1. Acknowledgement

This Agreement is between you ("End User") and Christian Bürger ("Developer"), and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content. This Agreement may not conflict with the Apple Media Services Terms and Conditions.

2. Scope of License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time, unless authorized by the Usage Rules.

3. What the App Does — and Does Not Do

NZBolt is a download manager that processes NZB files using Usenet (NNTP) servers that you provide and configure. The App does not include, host, index, search for, or provide access to any content. The App does not supply Usenet server access — you must have your own account with a Usenet provider.

You are solely responsible for the content you download and for compliance with all applicable laws in your jurisdiction. The Developer has no knowledge of, control over, or responsibility for any content downloaded through the App.

4. Restrictions

You agree not to:

• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
• Modify, adapt, or create derivative works based on the App.
• Redistribute, sublicense, rent, lease, or lend the App to third parties.
• Use the App for any purpose that violates applicable local, national, or international laws.

5. Maintenance and Support

The Developer may provide updates or support at its discretion. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Support inquiries can be directed to: christian@nzbolt.app

6. Warranty Disclaimer

The App is provided "as is" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Developer's sole responsibility.

This warranty disclaimer does not affect your statutory rights as a consumer under applicable law, including mandatory consumer protection laws of the European Union and Germany.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App.

This limitation does not apply to liability for damages caused by intent or gross negligence, to liability under the German Product Liability Act (Produkthaftungsgesetz), or to any mandatory liability that cannot be excluded under applicable law.

12. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. If you are a consumer within the EU, you also benefit from the mandatory consumer protection provisions of the law of your country of residence.

13. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies.
